THE LAST WILL AND TESTAMENT

Benjamin L. Patch of the City of Mount Carroll, in the County of Carroll and State of Illinois, made and pub- Listed the 5th day of January, in the year of our Lord One Thousand, Nine Hundred and Nine.

In the name of God, Amen: I, Benjamin L. Patch, of the City of Mount Carroll in the County of Carroll and State of Illinois, at the age of eighty years and being of sound mind and memory do hereby, make, publish and declare this my Last Will and Testament, in manner following, that is to say:

First – It is my will that all my funeral expenses, including a monument to be placed at my grave, the cost of said monument not to exceed the sum of Two Hundred Dollars ($200.00.) costs of administration, all just debts, Inheritance Tax, and other lawful Taxes, be fully paid.

Second – After the payment of my just debts, funeral expenses, costs of administration, Inheritance Tax and other Taxes, I give and bequeath my gold watch and gold chain to my Grand Nephew Elliot Benjamin Newton, of Wyoming, Pa.: son of my Niece, Ella M. Newton, daughter of my brother, James E. Patch.

Third – I give and bequeath to my brother James E. Patch, of New Albany, Bradford County, Pennsylvania, One Hundred Dollars ($100.00) in money.

Fourth – I give and bequeath to my Grand Nephews, Ira A. Roberts of Berwick, Pa., Clayton Roberts of Nanticoke, Pa., Grand Nieces, Minnie E. Haydon, of Scranton, Pa., Lora V. Miller of Bloomsburg, Pa., Emma A. Severance of Bloomsburg, Pa., only surviving children of my deceased Nephew, Martin S. Roberts, each, the sum of Fifty Dollars ($50.00) in money. And to Cora Severance, Stanley Severance, and Lena Severance of Bloomsburg, Pa., only surviving children of Mary J. Severance, a deceased daughter of my deceased Nephew, Martin S. Roberts, I give and bequeath, each, the sum of Twenty-five Dollars ($25.00) in money.

Fifth – I give and bequeath to my Grand Nephew, Arthur Roberts, of Buffalo, N.Y., only surviving child of my deceased Nephew, George A. Roberts, Fifty Dollars ($50.00) in money.

Sixth – I give and bequeath to my Grand Nephew, Fremont E. Cramer, of Seattle, Washington (3925 Linden Avenue) son of my deceased Niece, Lorinda Cramer, four Hundred Dollars, ($400.00) in money.

Seventh – I give and bequeath to my Grand Nephew Fremont Roberts, and my Grand Niece, Eva Refenbary, of Montrose, Pa., only surviving children of my deceased Nephew, Nelson C. Roberts, each the sum of fifty dollars, ($50.00) in money.

Eighth – I give and bequeath to my Grand Nephew, George Sturdevant and my Grand Niece Vida Sturdevant of Silvara, Bradford County, Pa., only surviving children of my deceased Niece, Grace Sturdevant, each, the sum of fifty Dollars, ($50.00) in money.

Ninth – I give and bequeath to Lydia Holy wife of Jacob Holy, of Carroll County, Illinois, my combination Book Case; Calendar clock, two albums and Photographs; Books and Pictures that are in my residence on Clay Street, in the City of Mount Carroll, Illinois, and One Hundred Dollars ($100.00) in money.

Tenth – I give and bequeath to Mary Durham, wife of George S. Durham, of Mount Carroll, Illinois, all my household and kitchen furniture (except combination Book Case and Calendar Clock) in my dwelling house on Clay Street in the City of Mount Carroll, Illinois.

Eleventh – I give and bequeath to my friend, Benjamin L. Smith of Mount Carroll, Illinois, all my office furniture and fixtures, books and pictures in said office, and Two Hundred Dollars ($200.00) in money.

Twelfth – I give and bequeath to my friend, Horace N. Griffith, of Shannon, Illinois, my double barrel shot gun and belongings, and One Hundred Dollars ($100.00) in money.

Thirteenth – I give and bequeath to Mrs. Etta J. Smith of Mount Carroll, Illinois; Two Hundred Dollars ($200.00) in money.

Fourteenth – I give and bequeath to Mrs. Elizabeth L. Sautbin, of Red Oak, Iowa, Three Hundred ($300.00) in money.

Fifteenth – All the rest, residue and remainder of my estate, of every kind and description, including the proceeds of the sale of all my real estate, to be sold and conveyed by the Executor of this my Will, I give, devise and bequeath to my Niece Ella M. Newton, Wyoming, Pa., a daughter of my brother James E. Patch, one third, and I give, devise and bequeath to my Niece Dora E. Cregg of Spearfish, South Dakota, a daughter of my deceased brother, Isaac C. Patch, one third, and the remaining one third, I give, devise and bequeath to my Nephew, Eugene A. Roberts of Meshoppen, Pa., my Niece Jane M. Love, Meshoppen, Pa., and my Niece Lillis M. Baldwin, Skinners Eddy, Pa., only surviving children of my deceased sister, Lorinda E. Roberts, share and share alike.

Sixteenth – It is my will in case any of the legatees shall die before my decease, leaving living child or children, such child or children to take the share that such legatee would be entitled to if living.

Seventeenth – I will and Ordain That the Executor of this my Last Will and Testament, hereinafter named, for and towards the performance of my said Will and Testament, shall with all convenient speed after my decease, sell, at public or private sale, as he shall deem best, and convey all real estate that I may own, possess or have interest in at the time of my decease, for the d___g, executing and perfect finish____ whereof,_____ do by these presents give to my said executor full power and authority to grant, bargain and sell all of the real estate I own or have interest in at the time of my decease and to execute and deliver good and sufficient deed or deeds therefor to the purchaser or purchasers thereof. Patch inserted here) And I authorize and direct Executor to sell, assign and transfer all shares of capital stock that I may own at the time of my decease in First National Bank of Mount Carroll, Illinois; First State Savings Bank, Mount Carroll, Illinois, and the Mount Carroll Hotel Company, Mount Carroll, Illinois.

Lastly – I hereby nominate and appoint my friend, Joseph S. Miles without Bond, to be Executor of this my Last Will and Testament. But in case of his death or refusal to become such Executor, I hereby constitute and appoint, without Bond, my friend Jacob H. Miles, the Executor of this Will, hereby revoking all former Wills by me made.

In Witness Whereof, I have hereunto set my hand and seal the 5th day of January, in the year of our Lord, One Thousand nine Hundred and nine.

The above Instrument, consisting of five pages was now here subscribed by Benjamin L. Patch the Testator, in the presence of each of us, and was at the same time declared by him to be his last Will and Testament, and we at his request and in his presence, and in the presence of each other, subscribe our names as attesting witnesses:
