(Chicago) - The kidnap-marriage litigation of Quinn O-Brien and Miss Margaret Eustice, formerly of Elizabeth, is to be re-opened through efforts of Attonry Theodore Miller counsel for Miss Eustice. He has made application in appelate court to permit testimony concerning an alleged marriage of O'Brien and Miss Eustice in Louisville KY. It is stated that O'Brien is under indictment in Louisville on charges of a false marriage with Miss Eustice in that city in May 1936.
Story continues - 2 February 1939 - The Illinois Appelate Court found that Quinn O'Brien was not the bridegroom of Miss Marguerite Eustice but it refused to grant the former city corporation counsel with an annulment. Ruling on an appeal from the Superior Court the appellate judges pointed out the trial court found that O'Brien was not legally married at Morrison IL Feb.3 , 1937 and then asked "How can the court annul that which never existed?" O'Brien who is 68 charged he was kidnapped by friends and relatives of Miss Eustice, confronted with a justice of the peace and forced to go through a wedding ceremony. Miss Eustice a 31 year old mother of a son named Quinn O'Brien Jr. alleged that she and O'Brien were married in Louisville KY, before the Morrison ceremony took place. On this the appelate judge said "We fail to see the logic in defendents efforts to maintain that there had been a previous marriage in Louisville. If a valid marriage had been performed then why did defendent go to the trouble of having a marriage performed in Morrison ?
