I, John Pollock of said county and state named, being of sound mind and memory, do make and desire this instrument of writing to be my last will and testament in form and provision following.
Namely: First I direct that my funeral expenses and all my just debts be fully paid.
Know all persons by these presents that an indenture with solemn bonifide, covenants made and acknowledged on the seventeenth day of September A.D. 1881 by & between Henry B. Pollock and Kesiah L. Pollock his wife, of the county of Menard and state aforesaid parties of the second part witnesses a certain contract of sale of lands made by the said 2nd party into the 1st party as in said indenture & mortgage described namely twenty four (24) acres off of the west side of the north west quarter of the N.E. quarter of Sec - thirty one (31) in township eighteen north range (5) west of the 3d - p.m. Also thirty six (36) acres of the south side of the N.E. quarter of the N.W. quarter of the section, township and range, aforesaid. By covenants of sale by second party a consideration was agreed upon of twenty seven hundred dollars ($2700.00) with annual interest of one hundred and fifty dollars (150.00) to be paid by said first party, to the second party or the survivors of them as is fully set forth and stated by the covenants of said indenture, as also secured by mortgage of the said first party all of which is recorded and acknowledged by the respective parties as above said on page 535 in Book L of Mortgages of said county.
Now I John Pollock do by this instrument confirm and bequeath to my children as therein named the share equal of the amount paid by Henry B. Pollock, his executors, administrators or assigns excepting all necessary support as stated in that said agreement for the use of said second party therein named, after the credit named in said agreement of one fourth of the principal on hand one fourth share & but named to be paid to James Pollock, Martha J. Derry, and Mary A. Buchanan or the issue as there in set forth.
And I further will and bequeath to Mary A. Buchanan my lot & house in Athens, known as Block No. One (1) in C. Halls Addition to the town of Athens, Ill., provided she the said Mary A. Buchanan pays to be paid tow hundred dollars to be consolidated with the amount subject to division between the four heirs as named in said article of covenant and agreement.
I also bequeath to my sons Simon L. Pollock, John W. Pollock & Thomas Pollock or their heirs the sum of one dollar as a quit claim against my estate.
And I hereby will and appoint Thomas Kincaid to be my executor of this my last will & testament to see that all the provisions of the article herein named is carried out and under the orders of the Probate Court to make as Executor the necessary titles to my Real Estate herein devised.
I hereby revoke all former wills by me made in witness whereof I John Pollock have hereunto set my hand and seal this fourteenth day of A.D. 1885
