In the name of God, Amen: - - I, Louis Schmidt, residing at this time with my son, Fred Schmidt, in Menard County, Illinois, being of sound mind and memory, in view of the uncertainties of life and desiring to make disposition of my property to take effect at my death, do make publish and declare this instrument as and for my last will and testament, in manner following, that is to say:
First, - I direct my executor to pay out of my estate, all my just debts and funeral expenses including the expenditure of a sum not to exceed one hundred dollars for a lot and tombstone for my grave.
Second, - It is my will and I direct that all the real estate which I may own at the time of my death shall be sold and converted into money, by my executor, as soon as my be practicable and to the best interests of my estate, after my death, such real estate to be sold at public sale for cash, and my executor shall collect and convert into money all notes and other evidences of indebtedness, as soon as practicable.
Third, - I give and bequeath and direct my executor to pay to that child of mine with whom I shall be living at the time of my death, for the care and nursing that may be required of him or her during my last days, the sum of two hundred dollars; provided that the acceptance of this bequest shall be in lien of any claim for such care with which he or the she may have against my estate, and if such bequest shall be refused under the above conditions, or such child should file a claim for such services against my estate, then this bequest shall abate and become a part of the residue of my estate to be disposed of as hereinafter set out.
Fourth, - All the rest and residue of my estate, remaining after the payment of the costs of administration and the payment of the debts and other bequests with herein provided, including all money in the lands of my executor from the sale of my lands, and the collection of all debts due and owing to me, and the sale of any personal property of which I may die seized, shall go to and be divided between my children, Louisa Jeske, Anna Janssen, Beta Scheibner, Henry Schmidt, Hannah Frerichs, and Fred Schmidt, - share and share alike, the part of any child who may be dead at the time of my decease to go to his or her descendants, and in case he or she shall have no descendants in the direct line, then said part or share shall go to and be divided between my heirs at law.
Fifth, - I hereby nominate and appoint my friend, Henry Balster, to be the executor of this my last will and testament, and in case of his death or refusal to act as such executor, then I nominate my son, Henry Schmidt, as such executor in his stead. I hereby revoke any and all former will by me made.
In witness whereof, I have hereunto set my hand and affixed my seal, this 12th day of July, in the year of our Lord, one thousand Nine Hundred and Three.
The above and foregoing instrument in writing consisting of two typewritten pages, was, on the date thereof, signed, sealed, published and declared, by the said Louis Schmidt, as and for his last will and testament, in presence of us, who, at his request and in his presence, and in the presence of each other, have subscribed our names as witnesses thereto.
