GRAYBILL, JOHN SHELLEY

John Shelley Graybill of Elkhart spent much of his adult life in courtrooms, a setting where he brought together his love of theater with his work as a trial lawyer.

''He was a lawyer because he had that sense of theater and he picked up some of that sense of theater from the law," said his son Jacob, of Wichita.

John Shelley Graybill, known to friends and business acquaintances as "Shelley," died Aug. 17, 1986. The funeral service was at 10 a.m., Tuesday in the Elkhart cemetery

Born on Nov. 17, 1915, in Newton, Mr. Graybill was one of three children of John and Bessie Graybill.

After graduating from Washburn University in 1939 with a law degree, Mr. Graybill went to work for the Kansas Department of Revenue and Taxation. A few years later he became an assistant attorney general and worked under Attorney General Jay Parker and later under Attorney General A.B. Mitchell.

In 1946 Mr. Graybill moved to Elkhart in Morton County in the extreme southwest corner of the state. For 32 years he served as city attorney for Elkhart in addition to his active private practice as a criminal defense lawyer.

''As a trial lawyer, his approach in trying cases was to use anecdotes and vignettes from history and relate the two in his arguments," said his son William, who went into legal practice with his father in 1976.

One of Mr. Graybill's most celebrated cases was the defense of William Addington, a grain dealer charged with fraudulently operating his Hutchinson grain elevator. Graybill continued to represent Addington even after he had gone bankrupt and could not pay legal fees. Ultimately Addington was convicted.

Mr. Graybill supported the community theater in Elkhart and acted in several productions. An avid practical joker, he frequently used his talent for acting to pull off a prank.

Besides his sons Jacob and William, Mr. Graybill is survived by his wife, Louise; a daughter, Nancy Carroll of Albuquerque, N.M.; a son, James, of Houston, and eight grandchildren.
