383 PROBATE COURT December 9th 1857
As aforesaid have permission, and she is hereby authorized to sell said personal estate_____a credit of twelve months from the day of sale, advertising the time and place thereof in three or more public places in this county thirty days previous thereto: and that she sell said estate at public auction to the highest bidder and require the purchaser or purchasers to give bond or bonds with approved security, for the purchase money: and report the proceedings in this behalf at the next term of this court.

223? In the matter of the application of Margaret Smith, widow of William Smith deceased for claims
It is ordered by the Court that this cause be continuous until the January term of this court.

In the matter of the petition of Margaret Smith, administrator/trix of the estate of William Smith, deceased, for sale of the real estate of the deceased, Upon reading and filing the petition of Margaret Smith administratrix of the estate of William Smith, deceased, and the exhibits? thereto annexted?, whereby it is represented to the court that the personal estate of said descedent is insufficient to pay his debts, so far as the said administratris has been able to discover the sums; it is thereupon ordered by this court that a citation issue directing all persons interested in the lands therewith and herediclaimants? of said decedent to appear before this court on the second Monday in February next? then and there to show cause, if any they can why so much of the lands, tenements and hereditaments ? of the said decedant, described in said petition, as, "as lying situate and being in this county, and containing about three hundred and twenty acres more or less, whereon said decedent resided in his life time," should not be sold, as will be sufficient to pay a part at least of said as habited ? against said estate ; and that said citation be put up in three of the most public places in this county for the space of thirty days: It is further ordered to the court that Matilda Farr, Samuel Farr, her husband, Eliza Fielder, & W. B. Fielder her husband, J. G. Smith, Lucinda A. Mosier & Philip B. Mosier, her husband, B. A. Smith, M. M. (or W. W.) Smith, G. W. Smith, V. W. Smith, R. H. Smith, E. H. Smith, M. S. or L., Smith, S. E. Smith, and M. E. Smith……...children & heirs at law of W. Smith. That V. W., R. H., E.H., M.S., S. E., & M. E. are minors. Dec. 1850 Term

Smith, children and heirs at law of the said W. Smith, deceased, be cited to answer said petition on or before the said February term of this court, to show cause if any they can why said sale should not be made. And it appearing to the court from said petition that the said V. W.Smith, R.H. Smith, E. H. Smith, M. S. Smith, S. E. Smith, & M. E. Smith, are minors; it is further ordined, that Chisley D. Key by appointed guardian ______________ of said minors to defend and protect their interest in this proceeding. Ordered, and decreed this 9th day of December, A. D. 1850. E. C. In the matter of the petition of said complainant for relief as one of the securities of said administratris.
On the return of the summons ordered and issued in this cause, the said Margaret Smith, administratris as aforesaid, having appeared thereupon, and offered as securities upon a new bond, Sam'l Pharr, B. A. Smith, & James G. Smith, who having appeared and justified, were deemed good & sufficient securities in the promises, and approved? and the said Administratris, having now pursuant? to the order and directions of this court, executed? with said securities a new bond for the faithful discharge of her duties in the sum of $ 16.00, the penalty of the first bond executed? by her, payable to the judge of this court & his successors in office; and it appearing upon inspections of the same, that it is in due form of laws, it is thereupon ordered that it be approved, filed and recorded, and that the said W. B. Smith be discharged from further detention? by virtue of said petition and summons? and go _______________ without ? day.
