Famous Case Decided - Downey vs Coykendall
Special Dispatch to the World Herald
Aurora, Nebraska, January 27. -- The famous case of Downey vs Coykendall, which has been on trial in the district court in Aurora this week, was closed this noon when acting under the instructions of Judge Corcoran, the jury brought in a verdict for the plaintiff, which provided that Coykendall should pay a penalty of $50, return all overcharges, amounting to $14.40, and pay the costs of the case.
Coykendall will appeal the case to the Supreme Court.
The case began three years ago, when forty members of the Aurora Commercial Club were arrested for maintaining a place in which intoxicating liquors were sold. They were tried in police court and fined. Mr. Coykendall was at that time police judge. The club members then started a suit against Coykendall charging him with overcharging in his fees. The district court then found for the plaintiff, upon the instructions of Judge Evans.
The forty different cases were then, consolidated and taken to Supreme Court. That court decided that such a consolidation could not stand and remanded the case to the district court.
In the district court only one case was tried. Downey, the present street commissioner of Aurora and one of the club members that was fined bringing suit against Coykendall. This is the suit that has jut been settled.
