MOSES BURTRAM & ELIZABETH his wife to GEORGE KELLY

This Indenture made the First day of July in the year of our Lord, one thousand eight hundred and Nine Between MOSES BARTRAM of the City of Philadelphia in the Commonwealth of Pennsylvania Druggist and ELIZABETH his wife (By EPHRAIM PENTLAND Esquire of the borough of Pittsburgh in the County of Allegheny in the said Commonwealth their Attorney in fact duly appointed by letter of Attorney & Recorded in Allegheny County 1st day of July A.D. 1809, Bearing date at Philadelphia the 6th day of December 1806 of the one part, And GEORGE KELLY of Butler County in the Commonwealth of Pennsylvania of the other Part Witnesseth that the said MOSES BURTRAM & ELIZABETH his wife for and in consideration of the sum of four hundred and forty two Dollars lawful money of the United States to Them in hand paid by the said GEORGE KELLY at or before the ensealing and delivery hereof the receipt whereof is hereby acknowledged Have granted bargained sold aliened enfeoffed released and confirmed and by these presents do grant bargain sell alien enfeoff release and confirm unto the said GEORGE KELLY his heirs and assigns A Certain tract of Land situate in Butler County Late Westmoreland County Pennsylvania in WILLIAM ALEXANDERS district No 3 of the depreciation Lands Called "Industry's Reward" Containing Two Hundred and sixteen acres and Twenty perches and allowance for Roads &c and marked in the survey and plan of said district Number Sixty Six It being the same Tract of Land which the Supreme Executive Council of the Commonwealth of Pennsylvania by Patent under the hand of BENJAMIN FRANKLIN President and the great seal of the state bearing date the twenty fifty day of April One thousand seven Hundred & eighty six duly recorded in the Rolls Office did grant and confirm unto the said MOSES BURTRAM and to his heirs and assigns forever Relation to the same Patent being had will more fully appear Together with all and Singular the buildings Improvements woods ways waters water courses rights Liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the revision and remainders rents issues and profits thereof and also all the estate right title interest property claim and demand whatsoever of them the said MOSES BURTRAM and ELIZABETH his wife in law or equity or otherwise howsoever of in and to the same To have and to hold the said described Tract of Land No 66 Containing as aforesaid two hundred and sixteen acres Twenty perches and allowances &c hereditaments and premises granted or mentioned or intended so to be with the appurtenances unto the said GEORGE KELLY his heirs and assigns to __ for the only proper use benefit and behoof of him the MOSES BARTRAM and ELIZABETH his wife covenant promise and agree to and with the said GEORGE KELLY his heirs and assigns by these presents that they the said GEORGE KELLY his heirs and assigns for ever. And the said MOSES BURTRAM and ELIZABETH his wife and their heirs the said described Tract of Land hereby granted with the appurtenances unto the said GEORGE KELLY his heirs and assigns against them the said MOSES BURTRAM & ELIZth his wife and their heirs and against all & every other person or persons whomsoever lawfully claiming or to claim the same shall and will warrant and forever defend by these presents. In Witness whereof the said MOSES BURTRUM and ELIZABETH his wife have hereunto set their hands and seals the day and year first above written sealed and delivered In presence EDWD PATCHELL, WM. Received on the day of the date of the above written Indenture of and from the above named GEORGE KELLY the sum of Four Hundred and forty two dollars lawful money of the United States being the consideration money above mentioned in full. E. PENTLAND. Test WM. JONES

Allegheny County ss: Be it Remembered that before President of the Courts of common pleas in the fifth court of Pennsylvania came EPHRAIM PENTLAND Esquire of Pittsburgh attorney in Fact for MOSES BARTRUM and ELIZABETH his wife by virtue of a Letter of Attorney in due form of Law from the said MOSES BARTRUM and ELIZABTH his wife dated the sixth day december in the year of our Lord one Thousand eight Hundred and six did acknowledge the foregoing, Indenture to be the act and deed of the said MOSES BARTRUM and ELIZABETH his wife for the purposes therein contained. In Testimony whereof I have hereunto set my Hand and that the Third day of July in the year of Our Lord One thousand eight Hundred & Nine. SAM ROBERTS. Recorded the 12th of February A.D. 1810
