GEORGE ADAM KOCH to JOHN GEORGE KOCH (both alias COOK) - Donated by Margaret Gagliardi
This Indenture made the twenty eight day of April in the year of our Lord one thousand Seven hundred and sixty seven Between GEORGE ADAM KOCH alias COOK, of Antrim Township in the County of Cumberland in the Province of Pennsylvania Yeoman of the one part and JOHN GEORGE KOCH, alias COOK of the same place yeoman of the other part. Whereas in pursuance of a Warrant from the Honorable the Proprietaries of Pennsylvania aforesaid bearing date the thirteenth day of April anno Domini one thousand Seven hundred and sixty five the Surveyor General consent to be Surveyed & laid out unto the said GEORGE ADM KOCH and JOHN GEORGE KOCH a certain Tract of land situate in Antrim township aforesaid adjoining JOHN SMITH, ABRAHAM KNEPNER & ADAM SMALL containing two hundred & thirty three acres and one hundred & thirty six perches and the allowance of six acres p Cent as by the Survey. Then of Remaining in the Surveyor Generals office at Philadelphia Relation being thereunto had appears by force and virtue of which said receipt Warrant & survey they the said GEORGE ADAM KOCH and JOHN GEORGE KOCH became joynt Tenants so as to hold the Estate in the Premises jointly Now This Indenture Witnesseth that the said GEORGE ADAM KOCH and JOHN GEORGE KOCH have agreed to make Partition and by these Presents do make a full perfect and absolute Partition of all that the above recited Tract of two hundred & thirty three acres & one hundred and thirty six perches of land to & amongst them the said GEORGE ADAM KOCH & JOHN GEORGE KOCH in two equal parts in manner following that is to say that he the said GEORGE ADAM KOCH his Heirs and assigns shall have hold & enjoy to the only proper use & behoof of the said GEORGE ADAM KOCH his Heirs and assigns forever all that piece of land being one full moiety or equal half part of the above said two hundred and thirty three acres & one hundred & thirty sixty perches of land Beginning at a Black oak in the line of ADAM SMALLs Land thence by the same North west fifty six perches to another black oak a corner of PHILIP STUMPs land thence by same north sixty eight degrees West one hundred & twenty eight perches to a post in the line of the said GEORGE ADAM KOCH's other Land thence by the same South thirty five degrees west ninety four perches and an half to a post standing in the division line thence by the same line South fifty nine degrees East one hundred & ninety seven perches & an half to a __ post for a corner in the line of ABRAHAM KNIPERS Land thence by the same north twenty five degrees East one hundred perches to the place of Beginning Containing one hundred and sixteen acres & one hundred and forty eight perches for the full part share & proportion of him the said GEORGE ADAM KOCH of and in all that the above said Tract of two hundred & thirty three acres & one hundred & thirty six perches of Land and premises and that the said JOHN GEORGE KOCH his Heirs & assigns shall have hold & enjoy to the only proper use and behoof of the said JOHN GEORGE KOCH his heirs and assigns forever all that piece of Land being the other one full moiety or equal half part of the above said two hundred & thirty three acres & one hundred & thirty six perches of Land Beginning at a marked Spanish oak a corner of JOHN SMITHs Lands thence by the same South forty two degrees East eighty one perches & an half to a Post thence by a old Surveyed line of marked trees South sixty eight degrees East one hundred & thirty three Perches to a marked spanish oak thence by WILLIAM KNIPERS Land north twenty eight degrees East sixty eight perches to a marked black oak a Corner of ABRAHAM KNIPERS Land thence by the same North twenty five degrees East twenty perches & an half to a post in the division line thence by the same line North fifty nine degrees West one hundred & ninety seven perches & an half to a post in the line of the said GEORGE ADAM KOCHs other land thence by the same South thirty five degrees West eighty four perches & an half to the place of Beginning Containing one hundred & Sixteen acres & one hundred & forty eight perches for the full part Share & proportion of him the said JOHN GEORGE KOCH of & in all that the said Tract of two hundred & thirty three acres & one hundred & thirty six perches of Land & premises and the said JOHN GEORGE KOCH doth by these presents grant release & confirm to the said GEORGE ADAM KOCH his Heirs & assigns all that the said first described piece of one hundred & sixteen acres and one hundred & forty eight perches of Land all the Estate Right Title & Interest which he the aid JOHN GEORGE KOCH hath or may or ought to have of in & to the same To have & To hold the said first described piece of one hundred & sixteen acres & one hundred and forty eight perches of Land & premises with the appurtenances to the said GEORGE ADAM KKKOCH his heirs & assigns to the only proper use & behoof of the said GEORGE ADAM KOCH his Heirs & assigns in severally forever And the said GEORGE ADAM KOCH doth by these presents grant release & confirm to the said JOHN GEORGE KOCH his Heirs & assigns all that the said last described piece of one hundred & sixteen acres and one hundred & forty eight perches of Land, and all the Estate right title & Interest which the said GEORGE ADAM KOCH hath or may or ought to have of in and to the same To have & to hold the said lst described piece of one hundred & sixteen acres & one hundred & forty eight perches of Land & premises with the appurtenances to the said JOHN GEORGE KOCH his Heirs & assigns to the only proper use & behoof of the said JOHN GEORGE KOCH his Heirs and assigns in Severality forever And the said JOHN GEORGE KOCH for himself & his Heirs doth covenant promise & grant to and with the said GEORGE ADAM KOCH his Heirs and assigns that he the said GEORGE ADAM KOCH his Heirs & assigns shall & may forever hereafter peaceably & quietly have hold occupy possess & enjoy the said first described piece of one hundred & sixteen acres & one hundred & forty eight perches of Land & premi8ses with the appurtenances herein before allotted & granted, for the part of the said JOHN GEORGE KOCH free & discharged of and from all other Estates rights titles interests & Incumbrances whatsoever had made on suffered hereafter to be had made or suffered for or by the said GEORGE ADAM KOCH his Heirs or assigns or of any other Person or Persons whatsoever lawfully claiming or to claim by from or under him them or any of them. I GEORGE COOK of Antrim Township in Cumberland County & Province of Pennsylvania Sends Greeting know ye that ye said GEORGE COOK for and in ye Consideration of ye sum of one hundred pounds Pennsylvania currency paid to him in hand by ADAM SMALL of the same place ye receipt whereof is hereby acknowledged hath bargained & sold & by the present doth grant bargain & sell unto ye said ADAM SMALL a certain Tract or piece of Land containing one hundred acres Situate in Antrim Township county & province aforesaid adjoining the land of JOHN SMITH FRANCES UREY & JACOB RUSHOUR ye said GEORGE COOK doth assign to ye said ADAM SMALL Ye aforesaid piece of Land Together with all & Singular the rights members and appurtenances belonging to ye said piece of Land Relative to ye above mentioned receipt to have & to hold ye said bargained Tract of Land & premises to ye said ADAM SMALL his Heirs & assigns forever Subject to ye Remainder of ye purchase & quit rents due to ye Honorable propriators thereon. Know all men by these presents that I HENRY ROADS of Antrim Township Cumberland county and province of Pennsylvania for and in consideration of the sum of six pounds of good Lawful money of Pennsylvania to me well and truly to be paid by GEORGE ADAM COOK of the aforesaid Township County and province, at and before the sealing and delivery of these presents the receipt whereof I do hereby acknowledge and thereof for ever acquit and discharge the said GEORGE ADAM COOK his heirs executors and Administrator by these presents have granted bargained sold released assigned and confirmed and by these presents do grant bargain sell release assign and confirm unto the said GEORGE ADAM COOK all that tract or parcell of Land Containing one hundred and fifty acres Joing and situated by LUDWICK HULL and ANDREW GEORGEs plantations in Cumberland county afforsaid in puruance of a Loctation granted to me the said HENRY ROADS for the same by the Honourable proprietors dated in the month February one thousand seven hundred and sixty Seven as by the said loctation remaining in the Land office of Philadelphia may appear together with all and singular the Improvements rights members, Hereditaments and appurtenances thereto belonging and all my Estate right title and Interest of in and to the same and every part thereof, to have and to hold the said one hundred and Fifty acres of Land Hereditaments and premsises with the appurtenances unto the said GEORGE ADAM COOK his heirs Executors Administrators and assigns for ever under and subject to the payment of the proprietory purchase money Interest and quit rent surveyors and other officers fas Now due, or hereafter to become due and payable for the same, and the said Land and premises unto him the said GEORGE ADAM COOK his heirs executors Administrators and assigns against me my heirs Executors and Administrators and against all and every other person and persons Lawfully claiming by from or under me or them I will warrant and forever defend by these presents, and I the said HENRY ROADS for myself my heirs Executors & Administrators shall and will at all or any time or times hereafter __ the reasonable request cost and Charges of him the said GEORGE ADAM COOK his heirs executors Administrators or assigns make do execute acknowledge and deliver __ cause to be done all and every such further and other Conveyances and Assurances in the law for granting and conveying the said tract of Land and Premises with the Appurtenances in the law for granting and conveying the said tract of Land and Premises with the Appurtenances unto the said GEORGE ADAM COOK his heirs Executors Administrators or assigns as by his or their Council Sealed in the Law shall be advised devised or Required. Know all men by these presents that I DANIEL McCOY of Antrim Township Cumberland County and province of Pennsylvania for and in Consideration of thirty seven pounds ten shillings Lawful money of the said province to him in hand paid by GEORGE ADAM COOK of the said Township Province the receipt of which is hereby acknowledged, hath granted bargained and sold and by these presents do Grant Bargain and sell Allien and set over unto the said GEORGE ADAM COOK his heirs and assigns a certain messuage parcel or tract of Land situate in Antrim Township Aforesaid beginning at a marked black oak tree & running thence south sixty nine degrees east Twenty seven perches to a white oak, thence south five degrees west sixty two perches to a whiteoak, south eighty nine west eight perches to an Ash, thence south eighteen west twenty one perches to a post, thence south Fourteen degrees West nineteen perches to a post, thence north Seventy three degrees west Twenty six Perches to a post thence by HENRY RODES & FRANCIS CUREY North thirteen degrees east one hundred & five perches to the beginning containing nineteen acres of Land more or less as the same was Surveyed & laid out, Together with all Singular the Building Improvements, Timper and Trees, ways Waters & water courses, rights members & Appurtenances whatsoever to the same belonging on in any wise Apertaining & the reversion & reversions remainders and remainders unto Issues & profits thereof and all the estate right Interest claim and demand of him the said DANIEL McCOY his Heirs and assigns of in & to the said Granted Land and premises with the Hereditaments and to every part thereof, unto the said GEORGE ADAM COOK to the only proper use and Benefit of him the said GEORGE ADAM COOK his Heirs and assigns for ever, giving and granting to the said ADAM COOK with the Land aforesaid the right too, and priviledge of the __ ran of and from his mill running through my other Land as now __ without let or Hindrance to __ the same, he the said ADAM COOK granting me in __ thereof the privildge of taking the water from, the floor gate of the said mill when Not going to water some meadows a meadow ground and the said DANIEL McCOY in behalf of himself & his heirs, doth covenant & promise to and with the said GEORGE ADAM COOK & heirs, the above mentioned Land & premises with the appurtenances shall and will warrant & for ever defend by these presents and that from any person or persons claiming or that my hereafter claim the same by from or under him, them or any of them under and subject always to the proprietary purchase money quit rents & Interest thereon due or to become due, to the Honourable the Proprietaries their heirs & successors. This Indenture made the Seventh day of September anno Donimi one thousand Seven hundred and sixty eight Between THOMAS BROWN of Entrim Township in the county of CUMBERLAND Yeoman of the one part and JOSEPH COOK of the said County yeoman of the other part. Witnesseth That the said THOMAS BROWN for and in consideration of the sum of thirty pounds lawful money of Pennsylvania to him in hand paid by the said JOSPEH COOK at or before the ensealing thereof the receipt whereof is hereby acknowledged and Confesed hath granted bargained sold released and confirmed and these presents doth grant bargain sell Release and Confirm unto the said JOSEPH COOK his Heirs and assigns a certain Tract of Land situate in the said Township and County bounded and descried as follows vizt. This Indenture Made this twenty first Day of April in the year of our lord one thousand seven hundred and sixty nine, by and between GEORGE COOK of Antrim Township in the County of Cumberland and Province of Pennsylvania Farmer of the one part, and JAMES McCLENAHAN of the Same place farmer of the other part. Witnesseth that the said GEORGE COOK for and in Consideration of the sum of Seventy three Pounds to him in hand paid or secured to be paid before the Sealing and Delivery hereof hath by these presents Granted bargained, and Sold unto JAMES McCLENAHAN a Certain tract or parcle of Land being situate and lying near Antietim Creek in the County and province aforesaid Adjoining the lands of JOHN MOORHEAD, JOHN MOCH, ALEXR. GORDAN, WILLIAM HALL, in pursuance of a warrant obtained for the Honorable the Propriataries of said Province bearing date December the Eleventh 1750 now lying in the land Office at Philadelphia as Appears by a Receipt of five pounds bearing equal date with said Warrant in part for the Same and said land lying to the East of said Lines herein after mentioned beginning where the Spring Run Emptys into the Pond at the lower end of the field Called the Calf pasture from thence by a Straight line to the middle of the upper fence of Said field, from there by a Straight line to an ash Sapling standing at the lower end of the meadow from thence by a Straight line to an ash tree Standing by the side of Run, from thence to an Elm Sappling standing by said Run, from thence by a straight line to where DANIEL McCURDYS Pine Crosses the Run from thence by a direct line to the north East line of Said tract Containing one Hundred and twenty Seven Acres more or less Provided always that said JAMES McCLENAHAN is to have no Right Title Claim, or Interest in a Certain piece of Timothy meadow now held by DANIEL McCURDY Included in said tract of land, Now Know Ye that I the said GEORGE COOK do grant bargain, sell, and deliver, unto the above named JAMES McCLENAHAN, all and Every of the above Related and described tract or parcel of Land Containing one hundred and twenty Seven Acres more or less for the Consideration above mentioned to me in hand paid the Receipt whereof I do hereby Acknowledged, and further I do hereby for my self my heirs Executors & Administrators, Confirm, Remise and Release to the above described tract of Land with all the Appurtenances thereunto belonging to the said JAMES McCLENAHAN his heirs Executors or Administrators forever, and also will Warrant and Defend the same from any person or persons whatsoever laying any lawful Claim thereto the Honorable the Proprietaries Excepted. This Indenture made the Twenty seventh Day of May in the year of our Lord one Thousand seven Hundred and Seventy four Between GEORGE ADAM COOK of the one part and PETER BAINBREGH of Guilford Township County ad Province aforesaid. Witnesseth that the said GEORGE ADAM COOK for and in consideration of the sum of Two Hundred and fifty pounds Lawfull money of the province aforesaid to him the said GEORGE ADAM COOK in hand paid by the said PETER BAINBREGH the Receipt whereof is hereby acknowledged have Granted bargained and sold and by these presents Do grant Bargain and sell unto the said PETER BAINBREGH all that Certain piece or Tract of Land which is now surveyed in pursuance of an order of survey bearing Date at Philadelphia the eighteenth Day of October in the year of our Lord one Thousand seven Hundred and sixty six, No. 1585 Adjoining JOHN GOUDEN in Antrim Township aforesaid I. This Indenture made the nineteenth day of November in the year of our Lord one thousand Seven hundred and ninety two between MARTIN COOK of Guilford Township in the County of Franklin and State of Pennsylvania yeoman and CATHARINE his wife of the one part and JOHN DICKSON of the Township County and State aforesaid of the other part Whereas by virtue and in pursuance of an order of Survey bearing date the twenty eighth day of March in the year of our Lord one thousand seven hundred and sixty eight number 4891, there was surveyed and laid off unto the aforesaid MARTIN COOK a certain Tract or parcel of land Situate lying and being in the Township County and State aforesaid formerly in the County of Cumberland Beginning at awhiteoak thence by land of JEREMIAH WARDER formerly JOHN JACK North forty four degrees East seventy Six perches to awhiteoak, thence South fifty four degrees East fifty two perches to awhiteoak thence South fifty degrees East twenty two and one half perches to a Spanish oak thence North forty four degrees East twenty three perches to a Hickory thence by land of ADAM KOOPS South Sixty and one half degrees East one hundred and twelve perches to a Hickory thence by land of WILLIAM ADAMS South fifty nine degrees West forty five perches to a Blackoak thence West Seventy five perches to a stone thence South eight degrees west nineteen perches to a Black ash by land of JNO's? Now this Indenture witnesseth that the said MARTIN COOK and CATHARINE his wife for and in consideration of the Sum of two hundred and fifty pounds Lawful money of the Sate of Pennsylvania to them will and truly in hand paid by JOHN DICKSON at and before the ensealing and delivery of these presents the receipt and payment whereof is hereby acknowledged by the Said MARTIN COOK and CATHARINE his wife Have granted bargained sold alien enfeoffed released and confirmed and by these presents doth grant bargain sell allien enfeoff release and confirm unto the said JOHN DICKSON and to his heirs and assigns for ever all that within described had tract or parcel of land containing seventy Seven acres and one hundred and twenty five perches and the usual allowance of six per cent for roads and hihg ways &c. Together with all and singular the buildings and improvements thereon erected and made ways woods waters water courses rights Liberties priviledges Hereditaments and appurtenances whatsoever to the same belonging or in any wise appurtaining and the reversion and remainders rents issues and profits thereof and also all the estate right Title Interest use trust property possession claim and demand whatsover of him the said MARTIN CLOOK and CATHARINE his wife of in to or out of the Same To have and to hold the within described tract or parcel of land containing Seventy Seven acres and one hundred and twenty five perches and the allowance &c Hereditaments and premises hereby granted mentioned or intended so to be with the appertences unto the said JOHN DICKSON his heirs and assigns to the only proper use benefit and behoof of him the said JOHN DICKON his heirs and assigns for ever Surveyed nevertheless to the payment of the purchase money Interest and quit rents now due and hereafter to become due and payable to the State of Pennsylvania. And the said MARTIN COOK for himself his heirs doth covenant promise grant and agree to and with the said JOHN DICKSON his heirs and assigns by these presents that he the Said MARTIN COOK and CATHARINE his wife their heirs and assigns the said Tract of Land hereby bargained and sold with the appurtenances unto the said JOHN DICKSON his heirs and assigns against him the said MARTIN COOK and CATHARINE his wife and their heirs and against all and every person and persons whatosever Lawfully claiming or to claim the same or any part thereof by from or under them or any or either of them shall and will warrant and forever defend. To All People to whom these presents shall come I JACOB FROSH of Hamilton Township in the County Franklin and State of Pennsylvania send Greeting Whereas I the said JACOB FRUSH obtained a warrant for the commonwealth of Pennsylvania bearing date the seventeenth day of November in the year of our Lord one thousand seven hundred and ninety To did grant to be surveyed unto me a Certain tract of Three hundred Acres of Land bounded by MARTIN COOK on the North JACOB COOK on the East McCORMICKs Land on the South JOHN ANDREW Esq on the South West LEONARD STANDS on the west and by WARDERS Land on the North West in Guilford Township Franklin County, as in and by the said Recited Warrant of Survey will more fully and at Large appear. Now know ye that I the said JACOB FRUSH for and in consideration of the sum of four hundred Pounds lawful money of Pennsylvania to me well and truly in hand paid by GEORGE COOK of the Township County and State aforesaid at and before the Ensealing and delivery of these presents , the Receipt whereof is hereby acknowledged, have granted bargained sold Assigned Released and Confirmed and by these presents do grant bargain sell assign Release and Confirm unto the said GEORGE COOK and to his heirs and assigns forever all my right Title Interest Property Claim and Demand whatsoever of in and to the said Recited Warrant of Land hereby granted to be surveyed in pursuance thereof with the appurtenances. This Indenture made the thirty first day of December in the year of our Lord one thousand seven hundred and ninety three Between JOSEPH COOK of the Township of Antrim in the County of Franklin and State of Pennsylvania yeoman of the one part and JOHN MOORLAND of the Township county and State aforesaid yeoman of the other part, Witnesseth that the said JOSEPH COOK for and in consideration of the sum of one hundred and seventy two pounds two shillings lawful money of Pennsylvania to him well and truly in hand paid by the said JOHN MOORLAND at and before the Sealing and delivery of these presents the receipt and payment whereof is hereby acknowledged by the said JOSEPH COOK, hath granted bargained sold alliened enfeoffed released and confirmed and by these presents doth grant bargain sell allien enfeoff release and confirm unto the Said JOHN MOORLAND his heirs and assigns a certain tract or parcel of land situate lying and being in the Township of Guilford in the County and State aforesaid bounded and described as follow to wit, Beginning at a Hickory and running with other land of the Said JOHN MOORLAND South sixty one degrees east fifty three perches to a post thence South five degrees west thirty five perches to a post with lands of the Heirs of ALEXANDER LONG decd thence with the Same South thirty one degrees west eighty perches to a Black oak Grub, thence by land of WILLIAM RONALDS North sixty and one fourth degrees west Sixty Seven perches to a Black oak Stump thence North twenty nine and one fourth degrees East one hundred and twelve perches to the place of Beginning containing forty three acres and twenty four perches and the usual allowance of six P Cent for roads and high ways. This Indenture made this ninteenth day of October in the year of our Lord one thousand seven hundred and ninety three Between GEORGE COOK, ADAM COOK, & MICHAEL COOK Executors of ADAM COOK deceased of the one part of Franklin County and Commonwealth of Pennsylvania, and DANIEL HUGHES of Washington County and State of Maryland of the other part. Witnesseth that they said GEORGE COOK, ADAM COOK, & MICHAEL COOK for and in consideration of the sum of one hundred and seventy four pounds seven Shillings and six pence lawful money of Pennsylvania to them in hand paid by the Said DANIEL HUGHES the receipt whereof they doth hereby acknowledge hath bargained and sold and by these presents doth grant bargain & Sell unto the Said DANIEL HUGHES a certain tract of land laying and being in Washington Township Franklin County Commonwealth aforesaid ajoining the lands of JACOB NIGHMIN, ABRAHAM KNIPPER, ADAM BERINGER, ABRAHAM KNIPPER and the mountain contain one hundred and fifty five acres & one quarter of an acre and usual allowance be then more or less as it will more fully appear by refference the Surveyors return. Be it remembered that GEORGE ADAM COOK by his last will & Testament bearing date the Sixth day of August one thousand seven hundred & eight four did order and direct, that the above described land should be sold and convey'd by the above GEORGE COOK, ADAM COOK, & MICHAEL COOK whom he appointed Executors reference to Said will in the Registers office of Franklin County will more fully appear. Now know that the Said GEORGE COOK, ADAM COOK, and MICHAEL COOK Executors of the last will and Testament of their father GEORGE ADAM COOK for the aforesaid Consideration of one hundred and Seventy four pounds seven Shillings & six pence doth hereby grant release and confirm the Said tract of land with the appurtenances thereon or thereunto belonging to the said DANIEL HUGHES his heirs & assigns for ever for his or their use & benefit and the said GEORGE COOK, ADAM COOK, & MICHAEL COOK for themselves and their heirs doth hereby these presents promise to warrant and defend the said tract or parcel of land as above described with the premises thereunto belonging to the said DANIEL HUGHES his Heirs Executors & assigns for ever and from all persons whatsoever laying claim thereto lawfully. This Indenture made this seventeenth day of august in the year of our Lord one thousand Seven hundred and ninety five Between JOSPEH ARMSTRONG of the Town of Chambersburg Franklin County and Commonwealth of Pennsylvania, attorney Specially constituted, by JOHN SHEETS of the County of Hampshire in the Commonwealth of Virginia and MARY his wife, as by their Power of Attorney bearing date the twenty fourth day of July in the year of our Lord one thousand Seven hundred and ninety five being on Record in the said County of Franklin reference thereto being had will show the said JOSEPH ARMSTRONG fully authorised to be of the one part, and GEORGE COOK and JACOB SHEETS of the County of Franklin and State of Pennsylvania of the other part. Witnesseth that whereas JOHN SHEETS late of Guilford Township and Franklin county died owner and Seized of a Certain Tract of Land Situate in said Township and County of Franklin, said to be held by warrant adjoining Lands of EDWARD CRAWFORD, PETER FRY, PETER SNIDER and others Containing two hundred acres more or less with the usual allowances &c and left a widow named ELIZABETH (who is since dead) and Seven children to survive him, to wit, MICHAEL, HENRY, JOHN, JACOB, ELIZABETH, CATHARINE and EVE, The said JOHN SHEETS died intestate by which his Estate descends to the aforesaid children to be divided agreeably to acts of assembly in such case made and provided. To the Honorable JOHN REED Esquire President, and ARCHIBALD BARD and ISAAC EATON Esquires Associate Judges of the Court of Common pleas now holden in and for the County of Franklin. The petition of HENRY COOK of Guilford Township. Respectfully represents. That previous to the eighteenth day of October anno Domini one thousand eight hundred and nineteen a Parole contract was entered into between Petitioner and a certain JACOB COOK late of said Township deceased, for an exchange of two certain pieces of Land, that on said day both the pieces of land were surveyed and off by Mr. ARCHIBALD FLEMING, that the part contracted for to be given by petitioner to deceased, was conveyed by Petitioner to deceased, by deed bearing date the eight day of April 1817 & 9 Decr 1819 and recorded in the Recorders Office of Franklin County in Liber 12, folios 324-325, that petition ever since the said survey hath been in possession of the premises delivered by deceased to him containing Four acres strict measure adjoining lands of JACOB SNIDER and beginning at a black oak on the line, between JACOB COOK & JACOB SNIDER, thence North sixty five degrees East, twenty three perches and one fourth to a black oak thence South forty three degrees and one half East, Twenty six perches to a post, thence South sixty three and one half degrees west twenty seven perches and three fourths to a post, thence north thirty three degrees west twenty five perches and three fourths of a perch to the place of beginning. Your Petitioner therefore prays that as the said JACOB hath since died intestate & no provision hath been made for perfecting the title of Petitioner to the premises aforesaid. Your honorable Court would award him a subpona for his Witnesses and fix a day for hearing them in support of the truth of the facts herein set forth. HENRY COOK
In open Court, ANTHONY BRETTS being duly affirmed doth say that he was present at a bargain between JACOB COOK & HENRY COOK by which HENRY COOK agreed to give to JACOB Two acres for the four acres contained and described in the said petition and that immediately after each party took possession of the premises and that afterwards said HENRY agreed & did give said JACOB as the consideration for the said four acres, one other acre additional making thence all of which three acres were sold and conveyed by JACOB COOK & wife to MRS. MARY BENDER, that the said four acres are properly described and since the bargain have mostly all been declared by HENRY in the life time of said JACOB and further Saith not. 22 April 1822 ___ ___ (signed in German)
At the same time came CHRISTIAN MYERS, Son in Law of JACOB COOK decd who being duly sworn deposeth and saith that he has heard JACOB COOK his father in Law, State that he was to give to HENRY COOK a deed for the four acres contained in said petition, as he had got first Two acres and then one making three Sold to MARY BENDER - that HENRY COOK has had possession for three or four years has cleared the most of it in the life time of JACOB COOK & has raised grain thereon and farther saith not. 22 Ap 1822.
