WILL of EDWARD KELLY

Dated 13 November 1829, Proven 3 January 1830

In the name of God amen! I EDWARD KELLY of Mifflin County in the Town of Newton, Hamilton, being in perfect health and sound in mind memory and understanding being mindful of my mortality do make and constitute this my last will and testament. First and principally I recommend my soul to God and when it shall please God to separate it; my body to be buried decently, at the discretion of my executors according to the rates of the Catholic Church And as to such worldly estate wherewith it hath pleased God to bless me, I give and dispose thereof as follows.

Item, It is my will and I do order and direct that all my estate, real and personal being in Lancaster County viz Two hundred and fourteen dollars in the Columbia Bridge Company Bank, in Lancaster County shall immediately after my decease be taken up by my Exors and from the sum thereof my just debts and funeral expenses paid (or as the case may be). I do nominate and appoint my friends JOHN MURRY and ALEXANDER BRADLEY both of Marietta, Lancaster County to be my exors of this my last will and testament. It is further my will that the money in the bank of Columbia shall be equally divided between my two sisters MARY and ELLEN KELLY of the lowland Hevin Parish of Lughim and County of Donegal Ireland.

It is further my will that of the said money taken from the Bank ten dollars shall be given to REV WM O'REILEY Roman Catholic pastor Huntington. I publish and declare this and none other to be my last will and testament. In witness whereof I have hereunto set my hand and seal this thirteenth day of November one thousand eight hundred and twenty nine.

Dated 4 August 1768, Proven 13 Oct 1768

In the name of God, Amen August the Fourth 1768 GEORGE KELLY of Derry Township in Lancaster County being Weak and sick in Body but of perfect Mind Memory for which I desire to bless God and calling to mind that it is appointed for all men once to Die. Do make and ordain this my last Will and Testament that is to say principally and first of all I recommend my Soul into the Hands of God who gave it and my body I Resign to the Earth to be buried in a Christian like Manner at the discretion of the Executors hereinafter mentioned nothing doubting my receiving the Same again at the General Resurrection by the Mighty Power of God and as for such worldly Estate wherewith it has pleased God to bless me in this life I give and dispose and bequeath the same in the following manner and form first to Discharge all my Lawful debts and I do give and bequeath to my Dear and Loving Wife ROSANNAH KELLY the Ront mare and colt and her saddle and bridle she is to have privilege to make a chaff Bed and Bed close and to have all the Flax and Hemp that now is on the Place for the use of her and the Children and her Little Wheel and the sum of Twenty five Pounds Lawful Money of Pennsylvania Currency the one half is to be paid two years after my Decease and the other half when my son ANDREW comes of age she is to have her living on the place while she lives unmarried and if the Place is sold she is to have one third of the Interest to herself while she is unmarried and if she marries she is to clear the place of all incumbence and to receive the above mentioned money and goods I give and bequeath to my Daughter RACHEL KELLY the sum of twenty five pounds when she come to eighteen years of age which is now seven years and three months old I also give and bequeath to my two sons ANDREW KELLY and THOMAS KELLY the Plantation where I now Live on and all the land that I now possess to be divided betwixt my two sons ANDREW and THOMAS equally when they come of age and to keep the red cow and the little Black cow and white heffer and the four sheep and five hogs that I now have all this to be put to the use of my wife and children while she is unmarried and if married there is six pounds of the value of the cows and sheep to be put to interest for RACHEL when my wife marries and if not married RACHEL is only to get six pounds when she comes of age and the rest to be divided equally among the four if any is left and she is to have the house that I now live in with my children till she marries and that part of the land that is unrented till Andrew comes of age if she lives unmarried and if she marries she has to leave the land and to have no right there the Executors is to make a Vendue after my Decease as soon as they think fit and sell all the Moveables but that piece of Shirtain that is at the Weavers and five pounds of Wool and some Blue Yarn and some two yarn all that is about the house of each sort to be kept for the use of the Children and my Wife and all the rest to be sold. But what the Executors thinks fit to keep for the use of the Children is to be raised and maintained clothed and Schooled upon the place without any other charge against them till they come of age in case the congregation is Brok or father or his sons Selling and going away or Det coming against the Place it to be sold with the consent of the Executors and PATRICK HAY and JOHN CAMPBEL it appearing to them that there is no other way to pay the debt but to sell the land all the Hay and Grain that is on the Place is to be kept for the use of the Familie and if any of it is left it is to be sold for the use of the children. I also appoint my Wife ROSANNAH KELLEY and PATRICK KELLY JUNIOR the only Executors of this my last Will and Testament Ratifying and Consigning this and no other as my last Will and Testament Revoking and Disallowing all former Wills Legasees Bequethments by me at any former time maid whether by word or writing. {Four words interlined there is thirteen words Crost in the fourth and fifty line from the top.}

One of the Subscribing Witnesses to the within Will and his Corporal Oath did depose and say that he was present and saw and heard GEORGE KELLY the Testator within named Sign Seal Publish pronounce and declare the within writing as and for his last Will and Testament and that at the doing thereof he was of sound Mind Memory and understanding to the best of his Knowledge Observation and belief.

Be it remembered that on the thirteenth day of October Anno Domini 1768 The last Will and Testament of GEORGE KELLY Late of Derry Township in the County of Lancaster Yeoman deceased was proved in due form of law and Letters Testamentary thereon were granted to ROSANNAH KELLY and PATRICK KELLY JUNIOR the Executors therein named they being first duly qualified well and truly to Administer the Estate of the said Decedant and to exhibit to true and perfect Inventory thereof into the Registers Office at Lancaster on or before the thirteenth Day of November next and to render a true and just account of their Administration on the said Estate then thereto Lawfully required. Given under the Seal of the said Office.

WILL of HUGH KELLEY

Dated 3 November 1793

In the name of God amen. I Hugh Kelly of Raphoe Township, Lancaster, County and State of Pennsylvania being weak in body but sound in mind and memory; and knowing that it is appointed for all men to die, do make this my last will and testament in manner and form following. First I recommend my soul to God that gave it and hoping to receive the same again from him the same that gave it and my body to be buried in a Christian manner at the discretion of my executors hereafter named and desire that all my just debts and funeral charges be paid out of my personal estate.

Item. I give and bequeath to my loving mother and two brothers Cormick and Darby to be equally divided among the three. Witnesseth this 3rd day of November 1793.

Will of John Liebrich

In the name of God Amen

I John Liebrich of Rapho Township in the County of Lancaster and State of Pennsylvania being old and weak but [???]of sound memory and understanding I therefore commend my soul into the Hands of my Creator trusting upon the mercy of my Redeemer and my Body to the Earth from whence it came. First I order and direct that my funeral expenses and just debts shall be paid out of my Estate after my decease. Secondly I order and it is my will that my beloved wife Catharine shall have all my Estate in her Hands & Possession until after her decease. Further I give and bequeath to my only son Nicholas the sum of Five Pounds aforehand for his Birth Right which said five Pounds shall not be paid to him until after the decease of my said wife Catharine. Item I give and bequeath unto my Fourth Daughter Margret the sum of Five Pounds aforehand which said five Pounds shall not be paid to her until after the decease of my said wife. Item it is my will and I order that after the decease of my said wife and not sooner (that is when my son Nicholas and my Daughter Margret each of them have received five pounds aforehand) the remainder left after the decease of my said wife shall be peacefully divided in equal shares amongst my children viz my Daughter Apolonia second Daughter Mary Elizabeth my son Nicholas my third Daughter Hanetta and my fourth Daughter Margret. Lastly I nominate and appoint my said beloved wife Catharine Executrix of this my last will and testament making hereby null and void all former and other wills by me heretofore made declaring this and no other to be my last will and Testament Done this thirtieth day of April in the year of our Lord on thousand seven hundred and eighty five.

Lancaster County on the twenty fourth day of October Anno Domini 1785 Before me the subscriber personally appeared Godlieb Spohn and Charles Smith the two subscribing witnesses to the above and foregoing will and on their Corporal Oaths Respectively did declare and say that they were present and saw and heard John Liebrich the Testator therein named sign seal publish pronounce and declare the above and foregoing instrument of writing as and for his last will and testament and that at the doing thereof he was of sound and well disposing mind memory and understanding to the best of their knowledge observation and Belief.

Be it Remembered that on the twenty fourth day of October Anno Domini 1785 the last will and testament of John Liebrich late of Rapho Township deceased was proved in due form of law and thereof having appointed his wife Catharine sole Executrix but the said Catharine having died before the said last will and testament was proved Letters of Administration with a copy of the Translation of the said last will and testament annexed were granted to Nicholas Liebrich the Eldest born and heir at Law of the said deceased he having given Bond with two sureties for well and truly to administer the Estate of the said deceased and especially to exhibit a true and perfect inventory thereof into the Registers Office at Lancaster within one month from this date and to Render a just and true account of his administration on said Estate within one year or when thereunto Lawfully required Given under the seal of said office.
