Article of Agreement

Between

Joel Ashcraft and Jesse Ashcraft

October 30, 1854


South Carolina
Chester District

 Article of agreement between Joel Ashcraft and Jesse Ashcraft of  the state and district aforesaid whereas John Scarborough of Landcaster district did on the 26 day of Jan’y 1849 make a deed of gift of his property consisting of 335 acres of land and two negroes other property to Joel Ashcraft on conditions that the said Joel Ashcraft should pay certain expences ~

I the said Joel Ashcraft do bind my self my heirs and assigns to warrant and defend the one third part of the above named property to the said Jesse Ashcraft and his heirs and assigns ~


I the said Jesse Ashcraft do bind myself my heirs to pay the one third part of the expences that has accrued or may accrue agreeable to said deed of Joel Ashcraft ~


It is further to certified that after the expences is paid if the said John Scarborough should consume the above named property I the said Jesse Ashcraft do not claim the rite to compel Joel Ashcraft to pay back any part of what he has expended ~


The understanding is that the above property is to be divided between Joel and Jesse Ashcraft after the expendetures are over Joel Ashcraft is to take two thirds and Jesse Ashcraft one third of what remains ~


Signed this thirtieth day of Oct one thousand eight hundred and fifty four ~

Received of T.K. Ashcraft Ext. nine hundred and sixty two dollars and 47/100 dollars


Received of Thomas K. Ashcraft Ext. of the Estate of Joel Ashcraft deceased nine hundred and sixty two dollars and forty seven cents in full of Jesse Ashcrafts part of their within named property after all nessisary expences having been paid that is to say one note on ….Clinton for seven hundred and eighty seven dollars and l…cents due the first of October and the balance in cash.
