E. H. Austin & Son vs. D. S. Kennedy
In this cause it appearing by affidavit that the defendant D. S. Kennedy is justly indebted to the plaintiff and is a non-resident of the State of Tennessee, so that the ordinary process of law cannot be served upon him, and an original attachment having been levied on his property: It is therefore ordered that publication be made in the Lexington Reporter for four consecutive weeks, commanding the said D. S. Kennedy to appear before me or some other acting Justice of the Peace at my dwelling house in the 13th civil district of said county on the 15th day of July, 1875, and make defense to said suit against him, or it will be proceded with ex parte. Mary J. Austin vs. Henry C. Austin, Emily N. Smith, Sarah S. Fisher, Martha L. Neal, David W. Austin, et. als. } in Chancery at Lexington, Tennessee, May 28th, 1875
It appearing from the bill which is sworn to, that David W. Austin, one of the defendants in this cause, is a citizen of Missouri, so that the ordinary process of law cannot be served upon him. It is therefore ordered that publication be made for four successive weeks in the Lexington Reporter, a newspaper published in the town of Lexington, Tennessee, commanding the said defendant, David W. Austin, to appear before said Clerk and Master at his office in Lexington, Henderson County, Tennessee, on the first Monday in July, it being Rule Day, 1875, then and there to make his defense to complainant's said bill, or same bill will be taken for confessed and set for hearing ex parte as to him. Thomas the defendant in this cause, is a non-resident of the State of Tennessee, and resides in Kentucky, so that the ordinary process of law cannot be served upon him: It is therefore ordered by me that publication be made in the Lexington Reporter for four consecutive weeks, commanding the said non-resident defendant John H. Thomas, to appear before the Clerk and Master at his office in Lexington, Henderson County, Tennessee, on the first Monday in July, 1875, it being Rule Day, then and there to make his defense to complainant's said bill or the same will be taken for confessed and set for hearing ex parte as to him. P. W. Austin vs. G. L. Swift
In this case it appears by affidavit that the defendant, G. L. Swift, is justly indebted to the plaintiff and is a non-resident of the State of Tennessee, so that the ordinary process of law cannot be served upon him, and an original attachment having been levied on his property. It is therefore ordered by the Court that publication be made in the "Lexington Reporter" a newspaper published in the town of Lexington, Tenn. for four consecutive weeks, commanding the said G. L. Swift to appear before me at my house in the 13th civil district of said county on the 4th day of December, 1875, and make defense to said suit against him, or it will be proceeded with ex parte.
