The State of Tennessee

 

                        Be it remembered that at a county court began and held for the county of Sevier at the court house in Methodist Church in the town of Sevierville (there being no court house) on the first Monday of April in the year of our Lord one thousand Eight hundred and fifty Six being the Seventh day of said month, present and presiding the following justices of the peace for said county towit    Morgan Davis chairman   John McMahan   James Proffit   F.L. This day B. M. Chandler presented to the court the following certificate of the Coroner of his election as clerk of the county court of Sevier County, towit,

I certify that at an election held at the Several district election grounds in my county on the 1st Saturday in March 1856 according to law B. M. Chandler was duly elected to the office of County Court clerk the following being the aggrigate State of the poles to wit for B. M. Chandler 611 votes, Lowrey McBath 305 votes, M. W. Poster 184 votes.  Given under my hand this 22nd March 1856,

And thereupon the Said B M Chandler executed the following bonds of office towit,

all of the county of Sevier and State of Tennessee are held and firmly bound unto the State of Tennessee in the penal sum of five thousand dollars for which payment well and truly to be made we bind ourselves our heirs Executors and administrators jointly and severally firmly by these presents signed with our names sealed with our Seals and dated this 7th day of April A D 1856.  The condition of the above obligation is such that whereas the above bound B.M. Chandler was on the 1st Saturday of March 1856

Monday 7th April 1856

duly and constitutionally elected clerk of the county court for Sevier County for the terms of four years.  Now if the said B. M. Chandler shall well and truly keep and preserve all the papers and records belonging to said county court clerks office and at all proper times have the same ready for the examination of all persons interested and at any and all times execute and performs such duties as by law he is bound to do by issuing processes paying out any and all moneys which may come into his hands, as such clerk to the proper person or persons his or her or their agent or attorney and will faithfully and honestly discharge all the duties incumbent on him by law, then this obligation to be void otherwise to remain in full force & virtue.

& firmly bound unto the State of Tennessee in the sum of Ten thousand dollars for the payment of which well and truly to be made we bind ourselves our heirs executors and administrators jointly and severally firmly by these presents signed with our names sealed with our seals and dated this 7th day of April 1856.  The condition of the above obligation is such that whereas the above bound B.M. Chandler was on the first Saturday of March 1856 duly and constitutionally elected clerk of the county court for said county for the terms of four years.  Now if the said B. M. Chandler shall faithfully and truly account for and pay over to such person or persons authorized by law or by any order or decree of said court to receive the same all such sums of money as may come into his hands as special commissioner to sell property under any decree of said court or as receiver under any order or decree of said court then this obligation to be void otherwise to remain in full force & virtue

This day Lemuel Duggan presented to the court the certificate of Saml Pickens coroner of Sevier County of his election to the office of Sheriff of Sevier County who gave bond and security as required by law and also took the necessary oaths of office, which bond is in the words and figures following towit,

Sevier County               )           Wilson Duggan   Enoch Underwood, Emanuel Fox, L W Burn and John T. Havis                                              all of the county of Sevier and State aforesaid are held and firmly bound unto the State of Tennessee in the penal sum of twelve thousand five hundred dollars for which payment well and truly to be made we bind ourselves our heirs Executors and administrators jointly and severally firmly by these presents sealed with our seals and dated this 7th day of April 1856.  The condition of the above obligation is such that whereas the above bound Lemuel Duggan has been duly and constitutionally elected Sheriff of the said county of Sevier for the term of two years from the first Saturday in March 1856.  Now if the said Lemuel Duggan shall well and truly execute and due return make of all process and precepts to him directed and pay and satisfy all fees and sums of money by him received or levied by virtue of any process into the proper office by which the same by the tenor thereof ought to be paid or to the person or persons to whom the same shall be due and owing to his her or their executor administrator attorneys or agents and in all things well and truly and faithfully execute the duties of the office of Sheriff as aforesaid during his continuance in office then the above obligation to be void otherwise to remain in full force and effect.                                                                        Lemuel Duggan (Seal)

This day James McNelly presented to the court the certificate of Saml Pickens coroner of Sevier County of his election to the office of Register of Sevier County who gave bond and security as required by law and also took the necessary oaths of office, which bond is in the words and figures following to wit,

Rawlings    all of the County of Sevier and State of Tennessee are held and firmly bound unto the State of Tennessee in the penal sum of Twelve thousand dollars for which payment well and truly to be made we bind ourselves our heirs executors and administrators jointly and severally firmly by these presents Sealed with our Seals and dated this 7th day of April 1856.  The condition of the above obligation are these that whereas the above bound James McNelly has been duly and constitutionally elected Register of Sevier County for the term of four years from the first Saturday in March 1856.  Now if the said James McNelly shall well and truly keep and preserve all the books and papers belonging to said Registers office and at any and all times have the same ready for the examination and search of all persons interested and does well and truly honorably and faithfully register any and all such instruments of writing as by law he is bound to do at such time or times as the same may be required and does honestly and faithfully discharge all the duties incumbent on him during his continuance in office then the above obligation to be void otherwise to remain in full force and virtue.

A. Rawlings Trustee as aforesaid shall well and truly execute the duties incumbent on him as Trustee by receiving and paying over all such sums of money which by law he is bound to receive and required to pay out and does faithfully and honestly discharge all the duties incumbent on him during his continuance in office then the above obligation to be void otherwise to remain in full force and virtue

Shields came into open court and having been duly elected Revinue (sic) collector for Sevier County for the year 1856 by the county court at the January term 1856 entered into bounds with goods and suffient securities and took the necessary oaths of office, which bonds are in the words and figures following towit,

of Tennessee in the penal sum of five thousand dollars for which payment well and truly to be made we bind ourselves our heirs Executors and administrators jointly and severally firmly by these presents signed with our names sealed with our seals and dated this 7th day of April 1856.  The condition of the above obligation is such that whereas the above bound John T. Shields was duly elected Revinue Collector for said county by the county court of said county on the 1st Monday of January 1856 for the collection of the State and County revinue for the year 1856.  Now if the said John T. Shields shall well and truly collect all state revinue which he is authorized and bound by law to collect and pay the same into the Treasury of the State of Tennessee or into the hands of such person or persons as are authorized by law to receive the same, then this obligation to be void otherwise to remain in full force and virtue.

Shields shall well and truly collect all county revenue and revenue for poor purposes which he is authorized and bound to collect and pay the same into the hands of the County Trustee or such other person or persons as are by law authorized to receive the same then this obligation to be void otherwise to remain in full force and virtue

This day Jeremiah Thomas presented the certificate of Saml Pickens Coroner of Sevier County of his election to the office of Constable in the 5th district of Sevier County who gave bond and security as required by law and also took the necessary oath of office which bond is in the following words and figures to wit,

This day David Keener presented the certificate of Saml Pickens Coroner of Sevier County of his election to the office of Constable in the 12th district of Sevier County who gave bond and security as required by law and also took the necessary oath of office which bond is in the following words and figures to wit,

Know all men by these presents that we David Keener   W A McNutt   Ephraim Johnson and Thomas Henry                are held and firmly bound unto the State of Tennessee in the penal sum of Four thousand dollars for the payment of which well and truly to be made we bind ourselves our heirs executors and administrators jointly and severally firmly by these presents sealed with our seals and dated this 7th day of April 1856.  The condition of the above obligation is such that if the above bound David Keener who has been elected a Constable of Sevier County for the term of two years from the first Saturday in March 1856, shall execute and due return make of all process and precepts by him received or levied by virtue of his said election and pay and satisfy all fees and sums of money by him received or levied by virtue of any process to the person or persons to whom the same may be due and shall well and truly collect all specific taxes within civil district No 12 of Sevier County which by law he is required and pay over to the proper officer authorized by law to receive the same within the time prescribed by law, and in all other things well and truly and faithfully execute and discharge the several duties of Constable during his continuance in office then the above obligation to be void otherwise to be in full force

This day Gilbert Galyean presented the certificate of Saml Pickens Coroner of Sevier County of his election to the office of Constable of Sevier County in District No 10 who gave bond and security as required by law and also took the necessary oath of office which bond is in the words and figures following to wit

Monday 7th April 1856.

Know all men by these presents that we Gilbert Galyean   George Wade   William Wayland   James M. Sharp  and Timothy Chandler are held and firmly bound unto the State of Tennessee in the penal sum of four thousand dollars, for the payment of which well and truly to be made, we bind ourselves our heirs executors and administrators jointly and severally firmly by these presents; sealed with our seals and dated this 7th day of April 1856.  The condition of the above obligation is such that if the above bound Gilbert Galyean who has been elected a constable of Sevier County for the term of two years from the first Saturday in March 1856 shall execute and due return make of all process and precepts by him received in virtue of his said election and pay and satisfy all fees and sums of money by him received or levied by virtue of any process to the person or persons to whom the same may be due, and shall well and truly collect all specific taxes within civil district No. 10 of Sevier County which by law he is required to collect and pay over to the proper officer authorized by law to receive the same within the time prescribed by law and in all other things well and truly and faithfully execute and discharge the several duties of constable during his continuance in office then the above obligation to be void otherwise to be in full force

This day James. B. Seaton presented to the court the the commission of the Governor of his election to the office of Justice of the peace for Sevier County dated the 27th March 1856, and the said James B Seaton was duly sworn as a justice of the peace for Sevier County as the law directs,

The jury of view heretofore appointed to view and mark out a road of the 3rd clap from the Gap of Bays Mountain at Creswells old mill seat to the Maryville Road make the following report to wit,

Sevier County               We the undersigned jury of view after being duly sworn did on this day proceed to mark out and law off a public road as directed by the court said road to commence at the gap of Bays Mountain thence running with or near the old road by Michael Fagalas and John Fagalas leaving the old road after passing John Fagalas barn running as marked to the top of the hill intersecting the old road then with old road to the big public road which we submit to the next quarterly court, Given under our hands this 16 Feby 1856

Ö          The jury of view heretofore appointed to mark out an alteration from the lower end of a place called Stalling Hill to the mouth of roaring fork made the following report towit,

We the undersigned persons being summoned out on the 5th April and being duly sworn and having viewed said road, Report the following alterations viz. at the long ford, let the road be put on the bar near the bank of the river and cross at right angle at the upper end of the ford, Thence at the second ford below Martin Claboughs leave the old road and run as heretofore marked so as to avoid the two fords, leave the old road below the double ford, and run as marked so as to miss and avoid double fords, leave the old road on the top of the hill below Noah Ogles and run as marked so as to intersect the old road above said Noah Ogles, We recommend the court to carry out the report of a jury heretofore made changing
