ibid       A Legal number of the Justices being present and voting in the affirmative it is ordered by the court that M. W. Porter be allowed Three dollars and twenty eight cents for clothing &c furnished Benj Trentham payable out of the Poor tax in the hands of the Treasury of the poor house not otherwise appropriated

ibid       Legal number of the Justices being present and voting in the affirmative it is ordered by the court that Lem Duggan Sheriff be allowed Twenty four dollars for his services attending on the county court from July Term 1855 to July Term 1856 and Twenty dollars for attending the circuit court for July Term 1855 to including March Term 1856 and Six dollars for attending the October Term 1855 and April Term 1856 of the Chancery Court payable out of the County Tax in the hands of the Trustee not otherwise appropriated

ibid       Upon the verbal petition of B.M. Chandler it is ordered by the court that Jas. W. Chambers, C A Clementson Joseph Rud William Catlett J.M. Hammond be appointed a Jury of view to view and report an alteration in the streets so as to reserve a site for building a new court house said site being selected by the building committee and that they report to the present term of this court

ibid       Upon the verbal petition of Wm Whaley it is ordered by the court that W T. Ogle Nicholas Ownby Jas Ownby Aaron Whaley John Ownby and Tennessee Pate be appointed a Jury of view to view and mark out a road of the 3rd Clap from F L Emerts farm on Hills Creek to intersect the Birds Creek road in the glades and that they report to the next quarterly term of this court

Upon the application James Lane by C Johnson it is ordered by the court that Calvin Johnson be authorized to procure a Crow bar and sledge for the use of the road which James Lane is overseer of and that he report the cost of the same at the next quarterly term of this court.

ibid       Ordered by the court that the road which John Baker is overseer of commencing at the forks of the road at Pleasant Pierces be extended to the top of the first hill west of James Clarks mill

ibid       Ordered by the court that the road which Elijah Shelley is overseer of commencing at Saml Cusick be extended to the top of the hill east of James Clarks house

ibid       Ordered by the court that the Sheriff after giving ten days notice proceed to sell the rock in the river near J. C. Yetts belonging to Sevier County

 

The Jury of view appointed today to view and report an alteration in the streets so as to reserve a site for the new court house

make the following report to wit  We the undersigned Jury of view having been duly summoned and sworn beg leave to report as follows that whereas the building committee have selected the middle of the streets for the most desirable spot for building the court house and we as a Jury of view think and see no other way of laying off said streets only be giving the entire advantage of the whole public square that is that the streets run on all four sides of the streets court house and that the contractor for building the courthouse be allowed what room will be necessary for his necessity on Either one side of main street this 8th July 1856

This day the court proceeded to the election of a coroner for said Sevier County when Lowery McBath was duly elected to said office who appeared in open court and gave bond in the sum of two thousand five hundred dollars with Jas. M. Evans & W. C. Pickens as his security and he was duly sworn according to law

The Honorable Samuel Pickens county judge proceeded to open the court to transact such business as is proper to come before his court, when the following proceedings were had to wit,

This day B. M. Chandler Clerk of this court presented to the court the following settlements to wit a settlement made with John McMahan Adm of the Estate of Elizabeth Maples a settlement made with Thas Maples Guardian to Benjamin Huft minor heir of John Huft Decd. a settlement made with Lewis Wayland Guardian to William Burn minor heir of Wilson Burn Decd. all of which is confirmed by the court and ordered to be recorded

The State of Tennessee

                        Be it remembered that at a county court began and held for the county of Sevier at the courthouse in Sevierville on the first Monday of August in the year of our Lord one thousand eight hundred and fifty six being the 4th day of said month present and presiding the Hon. Samuel Pickens Judge &c when the following proceedings were had to wit

 

This day M. A. Rawling County Trustee appeared in open court and gave bond for the money to be received by him for common school purposes which bond is in the words and figures following to wit

Sevier County               )           Know all men by these presents that we M A Rawlings  Jas W Chambers   William Mitchell & Cornelius Fox are held and firmly bound unto the State of Tennessee in the sum of four thousand dollars for which payment well and truly to be made we bind ourselves our heirs Executors and administrators jointly & severally firmly by these presents signed and sealed this 4th day of August 1856.  The condition of the above obligation is such that whereas the above bound M A Rawlings was on the first Saturday of March 1856 elected Trustee of Sevier County for two years.  Now if the said M. A Rawlings shall faithfully receive and pay over according to law all moneys which may come into his hands on account of common schools for the year 1856 then this obligation to be void otherwise to remain in full force and effect.  Witness our hands and seals this 4th day of August 1856

Monday 4th August 1856

This day Thas. C. Brabson Executor of the last Will of Reps J Davis Decd. came into court and gave a new bond for the faithful execution of said Will, in the sum of Twenty thousand dollars with B D Brabson as his security, the original bond having been destroyed.

This day T C & B D Brabson Executors of the last will of John Brabson Decd. came into court and gave a new bond for the faithful execution of said will in the sum of Thirty thousand dollars with M W McCown and                                 as their securities the original bond having been destroyed.

This day B. D. Brabson guardian to Ann Reps & John Davis Minor heirs of Reps J Davis Decd. came into court and renewed his bond as guardian in the sum of Twenty Thousand dollars with T. C. Brabson as his security the original bond having been destroyed by fire

This day B M Chandler clerk of this court presented to the court the following settlements, to wit, a settlement made with Perry Cate guardian to William A & Geo P Henderson minor heirs of Wm Henderson Decd. a settlement made with Thas Dunn guardian to James H Atchley minor heir of William Atchley both of which was confirmed by the court and ordered to be recorded

Upon the representation of B D Brabson guardian to Ann Davis it appeared to the satisfaction of the court that by the last will and testament of Reps J Davis that certain articles of personal property bedding &c had been left to the said Ann Davis and that said property is liable to be greatly depreciated in value before said ward becomes of age, it is ordered by the court that the said guardian be authorized to dispose of all or so much of said property at public or private sale as he may believe best to the interest of said ward.

Monday 4th day of July 1856.

This day William Atchley guardian to Isaac Atchley, Mary Atchley, Malissa Atchley, John Atchley, Enoch Atchley & Martha Ann Atchley minor heirs of Isaac Atchley Decd. came into court and renewed his bond in the sum of one thousand dollars with B. M. Atchley & Morgan Davis as his securities the original bond having been destroyed.

This day Morgan Davis Executor of the last will of Charles Reed decd. appeared in open court and renewed his bond in the sum of one thousand dollars with J. H. Atchley & Wm Atchley as his security the original bond having been destroyed letters Testamentary issued to him on the 1st Monday of Apl 1855.

This day Margaret Baker administratrix of the Estate of John Baker decd. filed a suggestion of the insolvency of said Estate.

This day Thomas Henry Guardian to Samuel Henry a minor came into court and renewed his bond in the sum of Two thousand dollars with Ephraim Johnson and Samuel H. Ellis as his securities the original bond having been destroyed by fire

This day William A McNutt guardian to Benj S Davis minor heir of Reps J Davis Decd. came into court and renewed his bond in the sum of Eight Thousand dollars with Jno G McNutt & L W Burn as his securities the original bond having been destroyed by fire

This day Shannon Felker admr. of the Estate of St Clare Shannon appeared in open court and renewed his bond in the sum of two thousand dollars with Cornelius Fox & J. W. Hammer as his securities the original bond having been destroyed by fire

Monday 4th Augt 1856.

This day John S McNutt administrator of the Estate of John F Fowler decd. appeared in open court and renewed his bond in the sum of twenty thousand dollars with W A McNutt & J Stafford as his securities the original bond having been destroyed by fire.

This day Adam Houk administrator of the Estate of Catharine Thomas decd. appeared in open court and gave a new bond in the sum of one thousand dollars with Henry Houk as his security, the original bond having been destroyed by fire.

This day Cornelius Fox guardian to Nancy Elizabeth Mitchell & Spencer A Mitchell minor heirs of Nelson Mitchell decd. came into open court and renewed his bond in the sum of five hundred dollars with Emanuel Fox & R S Clark as his securities, the original bond having been destroyed, by fire.

Margaret Baker administratrix of the Estate of John Baker decd. having filed a suggestion of the insolvency of said estate, it is ordered by the court that said administratrix shall give notice in the Knoxville Register and also in writing at the court house door in Sevierville for all persons having claims against said estate to appear and file the same authenticated in the manner prescribed by law on or against the 1st day of January next

Saml Pickens judge &c when the following proceedings were had, to wit,

 

This day B D Brabson one of the Executors of the last will & testament of John Brabson decd. presented to the court a certified copy of the last will of said John Brabson decd. and it appearing to the satisfaction of the court that the original Will and the record of the same has been burned up and, it appearing to the court from the testimony of M W McCown & B M Chandler that the certified copy now presented is in the hand writing of W. S. G. Ford former clerk of this court and that his certificate dated on the 31 July 1849 at which time the said Ford was clerk it is therefore ordered by the court that said certified copy of said will be admitted to record.

This day Hiram Bogle guardian to Joseph B Davis & Precilla J Davis minor heirs of Reps J Davis decd. appeared in open court and renewed his bond as such guardian in the sum of sixteen thousand dollars with John S McNutt & David McCroskey as his securities.

This day B M Chandler clerk of this court presented to this court a settlement made with Adam Houk administrator of the Estate of Catharine Thomas decd. which settlement is confirmed by the court.

            In this cause it appeared to the satisfaction of the court from the evidence of Henry Newman & R S Clark that it is clearly and manifestly to the interest of Spencer A Mitchell and Nancy A Mitchell to have the land warrant hereafter mentioned sold, on motion it is ordered and adjudged and decreed by the court that Cornelius Fox be and he is hereby appointed a special guardian for said Spencer A Mitchell and Nancy A Mitchell minors to whom the land warrant No 32272 for eighty acres issued, with special power and authority to sell assign and transfer said land warrant, it is further decreed by the court that said Cornelius Fox sell assign and transfer said land warrant for said minors as fully and completely as they could do if of lawful age, It appearing to the court that said Fox has given bond and good security for the faithful performance of said trust.

This day Wm Bohannon admr. of the Estate of Harcolas Ogle decd. appeared and renewed his bond in the sum of one thousand dollars with Stephen Huskey & W W Ogle as his securities the original bond having been destroyed

This day Joel Hudson one Executor of the last will of George Hudson Decd. presented to the court a certified copy of said Will of the said George Hudson decd. which is certified by W S G Ford former clerk of this court and it appearing to the satisfaction of the court & from the testimony M W McCown & G W Hammer that that the copy of said will & certificate are in the hand writing of the said W S G Ford former clerk it is therefore ordered by the court that said certified copy of said will be recorded, the original having been destroyed.
