Patrick Conner was drunk and disorderly on Wednesday night of this week, and was arrested by Officer McElhaney. Conner offered resistance and the officer struck him several times on the head with his mace, cutting him up in a frightful manner. Dr. Kurz rendered the necessary surgical aid and the man is doing as well as could be expected. Considerable feeling is manifested against the officer, and his conduct will be investigated by the proper authorities. [Wheeling Register, March 8, 1879 - Submitted by Debbie Quinn]

THE COURTS:

Yesterday’s Proceedings in the Different Judiciary Bodies:

Supreme Court – Judges Green, Haymond and Johnson

The court convened at ?0 o’clock and transacted the following business:

John B. Lukens & Bros., defendants in error, vs. Joshua Burley, plaintiff in error, Ohio county. In this case a writ of error and supersedeas were allowed as prayed for. Bond $400.

Remick et als, plaintiffs, vs. Ludington defendant, Greenbrier county. In this cause appeal to decrees and supersedeas to a portion of decrees as endorsed by Judge Haymond were allowed.

Hess vs. Thompson, Circuit of Berkeley county. In this case a writ of error was awarded as plaintiffs gave bond in penalty of $250.

Upon motion of George O. Davenport, Alfred Rhiemstom, of Wheeling, and T. P. Jacobs of New Martinsville, were qualified as attorneys-at-law.

Upon motion of George O. Davenport, B.H. Butcher, of Parkersburg, and R. W. Monroe, of Preston county, were qualified to practice in this court.

Adjourned until 2 o’clock this afternoon.

County Court – Judge Boyd:


This court met at 9 o’clock, signed the
mintues of the day previous, and adjourned until 9 o’clock this morning.

Police Court – Judge Cranmer:

Vagrancy – John McMann, Michael Cain, John Brown, Christina Gaffrey, John Seamon, Terry Rufter, James Burk and Frank Morris were each fined $2 and costs. The batch were sent to the stone pile.

Drunk – Morris Reubens and H.P. Challenge, fined $1 and costs each. Execution suspended on payment of costs. John Smith No.2, was sent to the workhouse.

Lewdness and Indecency – Jennie Moore and George Stollingfelt. The former was fined $10 and costs. Committed. The latter fined $2 and costs, which was paid.

In Self Defense:

Little Rock– August 1 – John Walker was shot and killed Saturday near Evermia Shade by Dall B. Rogers. It appears that Walkercame to Rogers’ gate and called for him to come out. Rogers emerged from his house thinking the baiting party was a friend named Henson, called him by name and invited him in. Walker responded by making himself known. When asked what he wanted he requested Rogers to step outside and he would show him, at the same time exposing a pistol he had in his hand. Rogersstepped into the house and, procuring a gun, came out on the porch and fired upon Walker, who turned and walked off. After walking a few steps he fell and died within an hour. Rogers fled, but subsequently surrendered himself to the officers. [The Wheeling Register, August 2, 1881]



Moonshiners Destroy Evidence and House Wheeling, W. Va
Two moonshiners learned the law was upon them- so close in fact they would have to run for it. They ran, but before they left their house, police said, the men destroyed the evidence by pouring a gallon of moonshine into an open fire. The "moon" blazed up so brightly it started a fire that destroyed the house before the officers could do anything about it.

The case against John Gallagher, who was charged with having obtained goods from Ed Larkin under false pretenses, was compromised at Pittsburgh and Gallagher was not brought back to the city as we were informed night before last. [Wheeling Register, March 8, 1879 - Submitted by Debbie Quinn]

A Suit for Damages
Today one week ago, a libel suit asking for $5,000 damages was brought by Lena
Yeakle, in the Circuit Court, against Conrad Rolf and wife. It is alleged that the trouble grew out of the Kreusch-Cassanova libel suit last year. [Wheeling Register, March 8, 1879 - Submitted by Debbie Quinn]
